This Privacy Policy describes how Zyvka ("Zyvka", "we", "us", or "our") collects, uses, discloses, and safeguards personal information when you use our website (the "Site"), our product Astra Agents (the "Service"), and any related services (collectively, the "Platform"). By accessing or using the Platform, you agree to this Privacy Policy. If you do not agree, please do not use the Platform.

1. Definitions

  • Account means a unique account created for you to access the Platform.
  • Personal Data means any information relating to an identified or identifiable natural person.
  • Usage Data means information collected automatically (either generated by the Platform or from third party sources) about how you access and use the Platform.
  • Service Provider means any natural or legal person or company who processes data on behalf of Zyvka.
  • Cookies are small files placed on your computer, mobile device or any other device by a website, containing details of your browsing history.

We may collect the following categories of information:

  • Personal Data you provide: when you (or your organization) register for an Account, complete forms, request a demo, upload or submit recruitment/resume data, contact support, etc. This may include name, email address, organisation/company name, telephone number, job title, billing/payment details (if applicable), resumes, candidate data, interview responses, and other profile information.
  • Usage Data: automatically collected when you use the Platform. This may include your IP address, browser type and version, pages visited, time and date of visits, time spent on pages, device identifiers, operating system and platform, referral source, click-stream data, and other diagnostic data.
  • Cookies and tracking technologies: We, and third parties, use cookies and similar technologies to track activity on our Platform and hold certain information; you can configure your browser to refuse cookies.
  • Third-party data: We may obtain data from external sources (e.g., verification services, business intelligence providers) in accordance with applicable law.

3. How We Use Your Information

We use the collected data for a variety of purposes, including:

  • To register and maintain your Account, provide access to the Service, manage your subscription and billing (if applicable)
  • To provide, operate, maintain and improve the Platform
  • To process and evaluate recruitment-related data (e.g., candidate screening, interview assessments) as part of the Service

  • To monitor, analyse and improve usage of the Platform, perform research and analytics

4. Legal Basis for Processing

Where required (e.g., under GDPR), we rely on one or more of the following legal bases:

  • Performance of a contract with you
  • Our legitimate interests (provided such interests are not overridden by your rights)

5. Disclosure of Your Information

We may share your Personal Data with:

  • Service Providers / Vendors: who perform services on our behalf (hosting, analytics, billing, security, etc.)
  • Affiliates and subsidiaries of Zyvka (if any)
  • Business Partners: if you choose to integrate or use partner services in connection with our Platform
  • Legal & Regulatory Authorities: when required by law, regulation, legal process or to protect rights, property or safety
  • Third-party candidate/employer flow: If you are using our Service in a recruitment context (uploading candidate data, running screening, sharing results with employers), you acknowledge that your data may be passed to employer-users or their systems as part of normal operations

We do not sell your Personal Data to third parties for their independent use.

6. International Transfers

Because we operate globally, your information may be transferred to (and stored at) destinations outside your country of residence (including the United States, India, European Union). We will ensure appropriate safeguards to protect your rights (e.g., standard contractual clauses, or as required in your jurisdiction). Where required, we will provide additional disclosures and rights.

7. Security of Data

We implement industry-standard administrative, technical, and physical security measures to protect your information (e.g., encryption in transit, access controls, audit logs). However, no method of transmission or storage can be guaranteed to be 100% secure.

We retain Personal Data only as long as necessary to provide the Service, comply with legal obligations, resolve disputes and enforce agreements. Usage Data may be retained for analytical purposes subject to appropriate safeguards.

Our Platform is not directed to children under the age of 16 (or as required by your jurisdiction). We do not knowingly collect Personal Data from children. If we become aware that we have collected data from a child without verification of parental consent, we will delete it.

We may update this Privacy Policy from time to time. The "Effective Date" at the top will reflect when it was last revised. Your continued use of the Platform after changes constitutes your acceptance of the changed Policy.

These Terms of Service ("Terms") govern your access to and use of Zyvka's websites, products, services, and applications, including Astra Agents and related platforms (collectively, the "Platform").

By accessing or using the Platform, you agree to these Terms. If you do not agree, please refrain from using the Platform.

If you are using the Platform on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

1. Definitions

  • "Account" means your registered account created to access the Platform.
  • "Candidate Data" means personal or professional information related to job applicants, prospects, or other individuals processed through the Platform.
  • "Content" means any data, files, text, images, audio, video, or other materials uploaded or transmitted via the Platform.
  • "Zyvka", "we", "us", or "our" refers to Zyvka and its global affiliates and subsidiaries.
  • "User", "you", or "your" refers to any individual or entity accessing or using the Platform.

2. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use the Platform.

When you register for an account, you must provide accurate and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and all activity under your Account.

3. Use of the Platform

Zyvka grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Platform in accordance with these Terms.

You agree not to:

  • Use the Platform for unlawful, fraudulent, or harmful purposes
  • Violate or infringe upon the rights of others
  • Reverse engineer, decompile, or attempt to derive the source code of any software in the Platform
  • Upload or transmit any harmful code, virus, or malicious script
  • Share, distribute, or resell the Platform without authorization
  • Use the Platform in violation of any applicable data protection or employment law

4. Candidate Data and Privacy

If you upload or process Candidate Data or personal information through the Platform:

  • You are solely responsible for ensuring that all data is collected and processed in compliance with applicable privacy laws (such as GDPR, CCPA, or India's DPDP Act)
  • You acknowledge that Zyvka acts as a data processor or service provider on your behalf for such data
  • You must obtain all necessary consents and provide appropriate notices to individuals whose data is uploaded
  • You remain responsible for the legality and accuracy of Candidate Data shared with Zyvka
  • Use of Candidate Data and other personal information is governed by our Privacy Policy

5. Intellectual Property

Except for the content you upload, all intellectual property rights in the Platform — including software, code, design, text, graphics, and trademarks — are owned or licensed by Zyvka.

You may not copy, modify, distribute, display, or create derivative works from any part of the Platform without Zyvka's written permission.

Any feedback or suggestions you provide may be used by Zyvka without restriction or compensation.

6. Subscriptions, Fees, and Payments

If you subscribe to any paid service or plan:

  • You agree to pay all applicable fees in accordance with your selected plan and payment terms
  • Subscription fees are billed in advance and are non-refundable unless otherwise stated
  • Zyvka reserves the right to modify pricing or plans with prior notice
  • Non-payment may result in suspension or termination of access to the Platform

7. Confidentiality

Both parties agree to maintain the confidentiality of all non-public, proprietary, or sensitive information shared in connection with the Platform.

This obligation continues even after termination of these Terms, except for information that is:

  • Publicly available without breach
  • Already known by the recipient
  • Required to be disclosed by law or legal process

8. Termination

Zyvka may suspend or terminate your access to the Platform if:

  • You breach these Terms
  • Required by law; or
  • Continued access may harm Zyvka, other users, or the Platform

Upon termination, your access will end immediately, and Zyvka may delete or anonymize your data as per its retention policy.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

Zyvka disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Zyvka does not guarantee recruitment outcomes, data accuracy, or compatibility with your systems.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Zyvka shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform
  • In no event shall Zyvka's aggregate liability exceed the total amount paid by you (if any) for the service during the three (3) months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Zyvka, its officers, employees, and affiliates from any claims, losses, liabilities, damages, or costs arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your breach of applicable law or third-party rights

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zyvka or its relevant affiliate is legally established, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the relationship between you and Zyvka shall be resolved as follows:

Good-Faith Resolution:

Both parties shall first attempt to resolve the dispute amicably through good-faith negotiations within thirty (30) days of written notice.

Arbitration or Competent Courts:

If unresolved, the dispute shall be submitted to binding arbitration or the competent courts in the jurisdiction where Zyvka (or its contracting affiliate) is registered, at Zyvka's discretion. Arbitration shall be conducted in English, and the award shall be final and binding.

International Enforcement:

Zyvka reserves the right to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property or confidential information.

Class Action Waiver:

To the extent permitted by law, both parties agree that all disputes will be resolved only on an individual basis and not as part of any class, consolidated, or representative action.

13. Amendments

Zyvka may revise or update these Terms at any time. Updates will take effect when posted on the Platform. Your continued use after changes constitutes acceptance of the updated Terms.

14. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements or addenda, constitute the complete and exclusive understanding between you and Zyvka, superseding any prior agreements.
